Terms of service

These terms apply to the website operated by Angraves Ltd, trading as Angraves Memorials (“we”, “us”, “our”). Our address is Units 1 & 2, Markfield Equestrian Centre, Stanton Lane, Markfield, Leicestershire LE67 9TT.

The store is hosted by Shopify. Shopify provides the platform we use to sell online.

By using this website or placing an order, you agree to these terms, our Privacy policy, Refund and returns policy and Shipping policy.

If you do not agree, please do not use the site or place an order.

We may update these terms from time to time by posting a new version on this page. The version in force when you place an order is the one that applies to that order.

1. Who can use the site

You must be 18 or over to place an order.

You must use the site lawfully and must not misuse it, attempt to break its security, or upload viruses or other harmful code.

2. How a contract is made

When you place an order you are offering to buy the goods. A contract is formed when we accept the order and send you an order confirmation, or when we dispatch the goods, whichever is earlier.

We may refuse or cancel an order if:

  • the item is out of stock or we cannot make it
  • there is an obvious pricing or description error
  • we cannot deliver to the address given
  • the order appears to be fraudulent, or placed by a reseller we do not supply
  • the personalisation requested is unlawful, offensive, or we reasonably refuse to produce it

If we cancel before dispatch, we will refund you in full.

Please check your details at checkout. You are responsible for giving a correct delivery address and, for personalised items, correct spelling.

3. Personalised and handmade products

Many of our products are personalised or handmade. Please check names, dates, verses and any other wording carefully before you pay. Once production has started we cannot normally change or cancel a personalised item unless it is faulty or we are required to do so by law.

Personalised and handmade items may vary slightly from website photos. Colour, finish and handmade detail can differ a little from screen to screen and from piece to piece.

We may refuse wording or artwork that is unlawful, abusive, defamatory, or that we reasonably consider inappropriate for a memorial product.

You confirm that you have the right to use any text or artwork you send us, and that it does not infringe anyone else’s rights.

4. Prices and payment

Prices are in pounds sterling and include VAT where applicable. Delivery charges are shown at checkout and explained in our Shipping policy.

The price you pay is the price shown at checkout when you place the order, except where there is an obvious error. If we find an obvious error after you order, we will contact you before going ahead.

We may change prices on the website at any time. That does not affect orders we have already accepted.

Payment is taken through our checkout payment provider. We do not store full card numbers.

5. Delivery

We deliver to the United Kingdom only. Dispatch times, Royal Mail options and what happens if a parcel is late or missing are set out in our Shipping policy.

Risk in the goods passes to you when they are delivered to the address you gave. Ownership passes when we receive payment in full.

6. Returns, cancellations and faulty goods

Your rights to change your mind, cancel before dispatch, and get a repair, replacement or refund for faulty goods are set out in our Refund and returns policy.

Nothing in these terms affects your legal rights under the Consumer Rights Act 2015 or the Consumer Contracts Regulations 2013.

7. Product information

We try to keep descriptions, photos and prices accurate. Photos are for guidance. Colours can look different on different screens.

If an important description is wrong, please contact us. Your legal rights for goods that are not as described still apply.

8. Using the website

The website, product photos, designs, wording and branding belong to us or our licensors. You may not copy, scrape or reuse them for your own shop or products without our written permission.

You must not:

  • use the site for anything unlawful
  • try to access other people’s accounts or data
  • interfere with the site or our checkout
  • use the site to send spam or harmful code

We may suspend access if we reasonably believe these terms are being broken.

9. Reviews, messages and suggestions

If you send us a review, message, idea or other content, you grant us permission to use it to run and improve the shop. We do not have to publish it or pay for it.

Do not send content that is unlawful, offensive, or that infringes someone else’s rights. We may remove content we reasonably consider unacceptable.

10. Privacy

How we use personal information, including order details and personalisation files, is explained in our Privacy policy.

11. Our liability

We are responsible for loss you suffer that is a foreseeable result of our breaking these terms or of our failing to use reasonable care and skill.

We are not responsible for:

  • loss that was not foreseeable
  • business losses, if you are buying as a consumer
  • problems caused by you giving the wrong address or the wrong personalisation
  • delays or failure caused by events outside our reasonable control, including Royal Mail disruption, though we will still deal with a lost or damaged parcel as set out in our Shipping policy

We do not exclude or limit liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that UK law does not allow us to exclude.

These terms do not affect your statutory rights.

12. Events outside our control

If we cannot fulfil an order because of an event beyond our reasonable control, we will contact you and take steps to reduce the effect. If the delay is substantial, you may cancel and receive a refund for goods not received.

13. Other terms

If any part of these terms is found to be invalid, the rest remains in force.

If we do not enforce a right straight away, we can still enforce it later.

These terms, together with the policies linked above, are the agreement between you and us for use of the website and for orders placed on it.

14. Governing law

These terms are governed by the law of England and Wales. If you are a consumer, you may bring a claim in the courts of England and Wales, or in the courts of your part of the UK if you live in Scotland or Northern Ireland.
